Good Morning,
Maybe some one can answer my question. I am in the process of updating our Land Patent in my husbands name, I have obtained the original patent from BML, have researched the abstract and have copies of all deeds from the beginning. My question is, the Land Patent was issued to the Rail Road and reads , Patent No. 9 list 5. I went to my court house and looked this up on the page described on the abstract and we are on that list, my question is, is this the number I use when updating ? Patent No 9, List 5?

Admin was out of town for the fourth of July holiday and respectively left your inquiry for anyone else to respond to; however, on our return we were surprised to see that no one had. Thus, we are providing this slightly belated response as follows:

You indicated that you are: “in the process of updating our Land Patent”; however, the whole point of the “Land Grant made Patent” (the Land Patent) is the fact that it cannot be changed or averted once it is signed by the sovereign authority that ‘made the grant Patent’ and so sealed the land patent (see: Land 101). Thus, what you suggest you are doing is impossible. A land patent cannot be “updated”. Thus, if your names are not already on the land patent in question, they never will be.

However, if you have secured the documents in the Chain of Title from the patent to the present, such that you can prove your assignment to the Title, then that chain of title proves you are one of the assigns named in the Land Patent. That is exactly why it is so important to secure the chain of title with either the original documents or certified copies of the same; so, you can prove your Title to the Land (which is the Land Patent itself). This is commonly misunderstood by people that do not know land law and especially by the predatory marketers that would like to have you believe the land patent will itself free you from property taxes and or from mortgage obligations. The land patent has no such magical power to free anyone from their contractual obligations.

Though we hope the clarification we provided above will help you, the support question you are asking regarding how you should list the land patent in your records would require an actual review of the documents in question; and, such a review is only available to either Team Law beneficiaries or those that have paid for our Land Patent Sandwich sample document service.
