Corp Presidential Qualifications

Postby Kiltit » Saturday February 2nd, 2008 1:28 am MST

This may be trivial, but I was in a discussion with some coworkers and we were at odds about reqiurments to be elected President. I was cited 1st, United States Naturalization Law of March 26, 1790 , which says nothing about naturalized "citizens" being allowed to become Pres if they were here after the signing of the Constitution. Then came ,The Immigration and Nationality Act (INA) of 1952 (Also known as the McCarran-Walter Act). Then there was this act, The Immigration and Nationality Act amendments of 1965 (Hart-Celler Act, INS Act of 1965, Pub.L. 89-236). From these arguments that I was given, I have yet to find anything in these documents stating that children born of American military parents while serving overseas, are eligeble to run for President, OJG or Corp Gov.
This stemmed from the debate over whether or not John McCain, being born in Panama, has the Constitutional or Public Law right to run and possibly win the Presidentcy.

:h: Kiltit:
The qualification for office requirements for the office of President of the United States of America have little to do with Corp. U.S.’ President; thus, discussions regarding the one have nothing to do with the other.

Thus, the Acts you referred to have nothing to do with the original jurisdiction Presidents office. Though we are not familiar with those Acts, we are familiar with the fact that natural Citizens of the United States of America are just that and if they are traveling abroad or even working outside of the country their children remain natural heirs to them and thus have every natural right any other Citizen of the United States of America has. Of course, they would have to come back here to their inherent native land to exercise their natural rights here. Thus, from that perspective alone, they could so qualify in the original jurisdiction; but there are other requirements. For example if they were born abroad and never returned with their parents to America, they would not so qualify because their natural nationality would never have been established and they would not have lived here for the required duration prior to office.

We do not expect John McCain has much of a chance for the Corp. U.S. office but we do not expect a challenge against him in original jurisdiction would have any merit (he would be considered an inherent natural born citizen) even though it may with a Corp. U.S. challenge if any Corp. U.S. Act prevents such a thing. If it were an issue, we expect the matter would be all over the news even now.

We hope this information is helpful to you.

As we noted in our last post in this topical thread, the Corp. U.S. election has nothing to do with the original jurisdiction election and respectively we have nothing to do with Corp. U.S.’s election either. Thus, we have no idea how your inquiry relates to Team Law at all, other than our effort to help people learn how to educate themselves in the law; thus, in that regard, we imagine you can answer your question by going to the United States Government statutes and look it up; still, considering that the elections are controlled by the Corp. State Secretary of State through their recorders offices, we also imagine you could simply call the Clerk and Recorder’s Office and ask them how you do a write in and they can tell you the answer to your question. That is what we would do.

We hope this information is helpful to you.
